Charlotte DUI & DWI Lawyers
If you are charged with a DUI (driving under the influence) or DWI (driving while intoxicated), a Charlotte DUI attorney at the Law Offices of Estwanik & May PLLC can help defend your rights against drunk driving and/or drug charges.
In North Carolina, DUI and DWI are different names for the same offense. However, depending on the circumstances, the amount of alcohol content, and whether the DUI is a repeated offense, penalties greatly differ in severity.
DUI/DWI penalties
No motorist may drive with blood alcohol content (BAC) that is .08 or above. For minors, there is zero tolerance for BAC, which subjects drivers with a BAC at .02 or above to DUI/DWI penalties.
North Carolina penalties are stiffer with each repeated DUI offense. First offenses result in court fines and community service for the first offense and possible sentencing of two years in prison for a second offense within seven years.
License revocation is generally one year with a first offense and revocation for life with a fourth offense. DUI offenses require an ignition interlock device (IDD) if BAC is .15 or greater.
How a DWI attorney can help
Various defenses exist and an experienced Charlotte drunk driving lawyer may be able to challenge whether the administration of the blood alcohol content (BAC) test or field sobriety tests was properly done, investigate for other procedural violations, seek reduced charges or fight for lighter sentencing.
